「我只想爭口氣,知道自己為什麼『弱』?」新竹市政府執行「汰弱留強」政策,上月26
日無預警以一紙公文解聘63名約聘雇人員,被解聘員工認為市府黑箱作業,完全沒有告知
解聘原因,且被定義為「弱」,嚴重打擊自尊和人格,合組「約聘僱人員及臨時人員自救
會」,將在25日前提起訴願,保障自身權益。
在文化局21年,考績連續20年甲等、也成為被「汰弱」的員工陳曉卿指出,上月收到公文
被告知解聘那天,她非常錯愕,不明白自己做錯什麼,尤其「弱」字,讓她覺得像犯錯被
掃地出門的員工,甚至連交接時間都沒有,當日告知、當日解聘,至今心中還掛念著許多
未完的工作。
影像博物館聘雇人員陳怡君紅著眼眶說,約聘雇人員形同「法律孤兒」,一點保障都沒有
,她經常假日加班,甚至為加強專業利用休假攻讀博士,想知道自己究竟哪裡表現不好才
丟掉工作。
律師邱顯智表示,市府以「汰弱留強」為由解聘員工,是對人員的抹煞和侮辱,令人不能
接受,根據大法官釋憲,剝奪人民工作權本應附理由,市府卻暗自黑箱作業,行徑離譜,
一定要為這些員工據理力爭。相關人員25日截止前,可到臉書搜尋「約聘僱人員及臨時人
員自救會」並加入。
市府人事處長陳旻表示,市長林智堅上任之初提及「汰弱留強」政策,公文才會提到這些
字眼,考量感受問題,已把政策更名為「人力活化」。
陳旻表示,人力活化政策有依循指標,例如曾有不良考核紀錄、或曾有申誡、連續2次考
核列乙等、曾有考核紀錄78分以下為參考標準,各單位主管再依平日工作表現和專業度,
排列聘雇優先順序,絕非黑箱作業。至於有不續聘人員要提訴願,市府予以尊重,這是他
們的權利。
