這是真的嗎?
來複習一下我去年寫的文章就知道了。
以前我常講,年金只要是「確定給付制」的,都要當成「確定賴帳制」來看。
去年的年改釋憲案,大法官更重新定義了「由政府負最後支付責任」的意涵,
以及將確定賴帳制的做法合憲。
解釋文怎麼說?
也就是法條雖然寫很清楚,是由政府負最後支付保證責任,但並沒有規定,當基金錢不夠
時,政府不能要求民眾先「多繳錢」、「晚退休」、「少領退休金」等,之後剩下的範圍
再由它負責。
而這種解釋方法,完全超出一般民眾的理解範圍。
所以才會有大法官寫不同意見書質疑,因為依一般人民觀點,普遍會認為,「由政府負最
後支付保證責任」一詞,就是最後由政府保證負責支付到底的意思,
但沒想到這次竟然解釋成,並未排除於基金收支確有不足時,政府得另採行其他因應措施
說白一點,就是法條雖然沒有要求對方應開源節流的明文規定, 但在法律解釋上,並不
排除有這種可能性。
請問一般人民能理解,所謂「政府負最後支付保證責任」,還有這種解釋法嗎?
既然解釋文都已經幫政府背書,未來用各種手段賴帳都合法合憲,那麼前面這些「政府負
最後支付責任」的規定還有任何意義嗎?
所以,用一句「政府會負最後支付責任」來輕輕帶過,只是拿來唬唬外行人,也是種不負
責任的做法。
其實臺灣人口老化、少子化是不可逆的趨勢,未來繳的人愈來愈少,領的人卻不斷增加,
加上基金績效又差,這些年金未來會不會改,只是很簡單的數學問題。但要怎麼改?那就
是複雜的政治問題了。
畢竟得罪少數人,還可以換到選票,但假如得罪到多數人,那就是「政權存亡」的差別。
不過不管基金何時破產,可以確定的是,經過這次釋憲案,政府的信用其實早就已經先破
產了。
(PS:有這種解釋文難怪後來可以把大法官叫進總統府洗臉XD)
