勞基法規定如下:
勞工在『同一』雇主或事業單位,繼續工作滿一定期間,給予特休。
1. 一年以上三年未滿:七日
2. 三年以上五年未滿:十日
3. 五年以上.....
也就是說當勞工換工作時,特休就歸零重新計算。也就是懲罰換工作的勞工。
就算工作了二十年,只要換了工作就沒有特休。一點都不合理。
很多外商或在國外的特休規定是只要待滿一個月就給N天的假。從到職開始計算。
勞工而言,除非是公司非常大,不然只要換公司通常就不是在同一事業單位。
就自動歸零。
公務員來說,就算調動單位也不影響其年資,還有很多國營事業也可以廣義的
通算公務員。更不用說其特休規定優於勞工。
因此勞工特休,較合理的計算應該是以勞保年資來計算。只要你當勞工,特休
年資就繼續累計。(新的勞退都取消同一雇主的爛規定了,特休應該也要改)
勞基法修了不少次,這項完全沒被提起。政府對勞工真的很差。
