公務員考績法草案將在三月底出爐。據了解,銓敘部將採對公務員最嚴格的「不設年限」
定義,增修「三次丙等就解聘」的新規定,未來公務員只要累計得到三個丙等,不管前後
相隔多少年,都將解聘。
這項新規定,攸關全國卅多萬名公務員權益,服公職不再是「鐵飯碗」。至於丙等上限比
例的問題,考試院內部有不同意見,目前尚未達成共識。
銓敘部研修公務員考績法改革,重點在「獎優汰劣」,訂定公務員的「退場機制」;若考
績丁等或者累積三次考績丙等,將遭資遣或被要求提早退休。
對於「三次考績丙等」如何認定,銓敘部原本將「三年內連續三次」、「五年內三次」、
「不設年限,公務員生涯累積三次」三案併呈,但考試院高層都覺得「三年內三次」和「
五年內三次」過於寬鬆,「有等於無」,不能造成「汰劣」效果。
至於「公務員生涯累積三次丙等即淘汰」的做法,銓敘部坦言,的確對公務員較不利,但
每個單位考績丙等的比例極低,「要在生涯內累積三次丙等也不太容易」;何況考績丙等
者,主管會先行輔導,假如又繼續拿丙,就證明輔導無效,這人確實不適任公務員。
公務人員也很關心的「考績丙等比例」問題,日前傳出考試院內部擔心公務員反彈,將「
縮小打擊面」,僅「團體績效評比」在後段班的單位,才訂出一定的丙等比例,且將比例
由百分之三至五,降低為一至三;但考試院高層指出,「這是不了解考績法新制的說法」
。
高層指出,訂定公務員考績丙等比例是既定政策,不可能變動;但每個機關人數多寡不同
,人數少的單位,可能和上層單位整體考量。
高層說,若考試院全院一起打考績,再依各單位表現微調丙等人數,評比結果可能造成某
些單位有數個丙等,某些單位一個丙等都沒有;但「有的單位少,有的單位就變多」,所
以不會有縮小打擊面的問題。
高層坦言,對考績法修法,確實有很大壓力,考試院內部也有不同聲音,但考試院不可能
在案子送出前就自我設限,要有任何改變,也是到立法院再說。
