一,
工程契約定型稿:
工程部分完工後,有部分先行使用之必要或已履約之部分有減損滅失之虞者
,應先就該部分辦理驗收或分段查驗供驗收之用,
二, 假設: 有十間辦公室裝修, 已七間完工裝修, 已完成查驗併供使用中(查驗時
有跟廠商講, 這是查驗, 不是部份驗收, 廠商也同意)
三, 假設工程如果可以如期完工, 查驗跟部分驗收其實差別不大,...
那現在出現的問題是: 假設工期0731屆止, 剩下一天已經確認無法完工
因為當初那七間是 "查驗"(雖然已經在使用中), 但
逾期違約金, 是不是要用十間去算 (就法論法) ?
ps: 也就是說, 廠商當初接受查驗後先供使用, 而不是要求部分驗收
現在是不是很不利???
