問題1:求職者被公司「放鳥」
情境:
小美7月5日收到公司的錄取通知,小美當天回覆願意接受職務,
並且將在7月15日上班,公司卻在7月13日報到前2天通知小美
公司人事凍結,不用報到。
說明:
徵才企業的錄取通知是「要約」行為,當求職接受offer即屬「承諾」,
雖然小美還沒到公司報到,但僱傭契約已經成立。
若小美認為「被公司放鳥」造成她的權益受損,
她可依法主張徵才企業須負起不履行契約的損害責任。

不過大部分人還是摸摸鼻子自認倒楣吧,
趕快找下一份工作比較實際一點
