揭露 明年縮工時 僱主3賤招
我國勞工法定工時明年元旦(周五)起改為單周40工時,是15年來首次縮短;而勞動部本
月修改《勞基法施行細則》將國定假日由19天減為12天作為配套,引發勞團抗爭。勞動部
稱,原已挪移國定假日實施周休二日的勞工不受影響,「隔周休二日」改「周休二日」的
勞工,在一加一減之後,全年總休假多出6天。
民批:政府騙人
但《勞基法》原條文中「7天中應有1天為例假」並未修改,有製造業勞工向《蘋果》投訴
,指公司原周休1日、每天工作7小時,明年起維持周休1日、每天少工作20分鐘,以6小時
40分鐘乘以6個工作天,符合單周40工時法令,還平白少7天國定假日,「根本沒周休二日
,政府騙人!」該勞工不透露任職企業。電資工會也指,曾接到勞工投訴僱主明年起每天
增給20分鐘午休,但上下班時間不變。
若扣薪可罰30萬
另有竹科勞工蔡先生投訴說,旺宏、聯電等科技廠,原已實施周休二日但仍照給19天國定
假;但政府宣布縮短工時後,這些公司卻公告明年國定假日減為12天,趁亂砍假。
旺宏回應,因應修法人資部正研究假日天數,但還沒定案。聯電不願回應此投訴,不過指
該公司原給員工的彈性假沒有變動,假日總數維持19天。
勞動部說,確有接獲勞工投訴企業以縮短每天工時、每周仍工作6天來因應,「雖不違法
,但市場會淘汰這樣待遇較差的公司」;企業若以修法為由,藉機降低原先優於法令的國
定假日天數也不違法,「政府會道德勸說」。但官員強調,企業若以縮短工時為由,片面
減少勞工薪資,可罰2到30萬元;若縮減福利則沒罰則,勞工若認為權益受損可提勞資爭
議協調。
應改7天2例假
文化大學法律系教授邱駿彥說,政府宣傳新法是和公務員一樣周休二日,但《公務員服務
法》明訂周休二日,《勞基法》卻無,勞工易失望。
電資工會秘書長林名哲說,勞工最在乎完整的休假,勞部應限制資方用各種方式因應,如
修法明訂7天中應有2天例假。
●賤招1:周休二日沒了
僱主以「每周工作6天、每天工作6小時40分」方式達成「每周40工時」
