卡拍謝,我工作是律師(執業三年,不敢說老,但也不菜了)
本所有些科技業的法人客戶,偶有這種所謂"勞資"訴訟要處理,
最近剛結束一件跟本篇主題幾乎一樣的訴訟,
又看了您的回覆,看了實在有感而發,
以下僅針對您這兩句話做回應:

從以上您的回覆,代表貴司:
1.明知業界素有所謂"薪資保密"之私法約定
2.明知求職者與原公司間有上開約定
3.求職者已明確表達,礙於上開約定,恐難提供薪資證明
文章開頭會說"有感而發",就是因為我有件案子阿
A公司告甲職員的理由,就是那位甲職員去面試B公司時透漏了原本薪資
所以A公司就真的開律師費去告甲職員,保密協議的懲罰性違約金也不過20萬
A公司卻也甘願花10萬律師費跟將近半年的時間去告那位甲職員
而且訴訟過程中不管調委怎麼勸(這件甚至連法官都自己跑下來調解)
A公司就是"堅不和解",堅持要法官"依法、依契約判決"..
我就覺得很納悶,這A公司擺明了要弄那個甲職員而已阿 =_=
那既然貴司也深知上面臚列的1~3點,為什麼還要求求職者提供薪資證明咧,
難道之後求職者被原公司告的時候,貴司會很阿莎力跳出來幫他扛下所有違約金嗎?
縱使答案是肯定,那貴司能"扛"的,也只有民事上的違約金而已吧,
畢竟誰能阻止原公司去告他刑事背信罪呢?
註:不要跟我扯甚麼背信罪不會成立,我當然知道單純洩漏薪資很難構成本罪,
但冗長的刑事程序(從一開始的偵查到之後可能到來的審判),
訴訟程序的過程,對受審者而言,就是一種有罪的結果.
