〔記者李雅雯/台北報導〕勞動部規劃修正「違反勞動基準法裁處罰鍰共通性原則」,內容細節首曝光。考量台灣微型企業多,勞動部擬以「不知者無罪」讓未滿5人事業單位在違反勞基法時可視情況減輕罰鍰或免罰;另擬讓僱用勞工人數滿200人以上的上市櫃公司加重其罰鍰到法定罰鍰最高額二分之一,將該部分寫入裁處原則。
勞動部在4月中旬和各縣市政府、經濟部等轄下單位召開會議,針對「違反勞動基準法裁處罰鍰共通性原則」修正內容進行討論。勞動部考量僱用勞工人數未滿5人的事業單位,因為其大多沒有專業人資人員,故擬援引行政罰法第8條「不得因不知法規而免除行政處罰責任。但按其情節,得減輕或免除其處罰」和行政罰法第18條,讓未滿5人的事業單位可依違法情節減輕罰鍰或免受罰。
「違反勞動基準法裁處罰鍰共通性原則」最近一次修正為去年10月,當時將上市櫃公司有違法加班、輪班間隔不足11小時和未有例假七休一等違法事實時的罰鍰抓為5萬元起跳納入裁處原則。勞動部本次擬再進一步修訂,由於僱用勞工人數200人以上的雇主或事業單位,大多設有專業人資人員,為了提高其法遵義務,只要是「上市或上櫃者」或者是「僱用勞工人數滿200人以上者」,違反勞基法將可處5萬元以上、100萬元以下罰鍰,且可加重其罰鍰至法定罰鍰最高額二分之一。
勞動部強調,現階段尚在彙整意見資料中,修正細節待研議,所有細節都尚未定案。勞動部今年勞檢方針為「微型企業以訪視輔導取代勞檢」,勞動部併軌擬修正違反勞基法裁處原則,該修正內容預計時程為6月可上路。
對於政府擬輕罰或免罰微型企業,有人認為台灣社會微型企業多,勞動法規多如牛毛,先指導和輔導會比直接開罰來得好;另也有人認為,弄懂勞動法規本就是雇主的責任之一,不該將其違反勞基法的風險轉嫁給政府和社會。
