最近因為案件需求
向某政府機關調閱資料(我在警察機關) 我們正式發公文去要
對方回文事涉當事人資料,依法未徵得當事人同意不給 也正式發文回復我們
就因為這樣我們案子辦不下去.我跟檢察官報告,她叫我再溝通溝通,要不然她發文也可
我們跟對方溝通 對方很強硬
我們說如果檢察署發文來調給嗎? 他說天皇老子來調都不給.只要當事人沒同意
他就站的住腳.
問題是我們去問了當事人,當事人就知道我們在調查他了.
難到要檢察官去申請搜索票,去搜那個公務機關,只為了那份資料到@@a?
請問這算妨害公務嗎?對方也是公務機關就是了.
