家父今年往生。生前在香港工作過留下一些遺產在香港。我們目前請了香港的律師
事務所跑probate承續。但是他們說需要在台灣也找有五年以上經驗的律師出示
affidavit。詳細香港律師行列的條件是：
1. You should be an expert of the law of Taiwan with proper
qualifications and/or a Taiwan lawyer with at least 5 years of
post-qualification experience;
2. Recite the facts of the case;
3. Confirm Mr. xxx did die domiciled in Taiwan;
4. Confirm that Mr. xxx has no valid wills;
5. State the applicable laws of Taiwan and cite the relevant provisions if
possible;
6. Confirm and state that Ms. xxx and her two sons are entitled in
priority to administer the estate of Mr. xxx and to apply for a grant in
accordance with the specific laws in Taiwan (relevant provisions cited); and
7. State whether a probate grant is required in Taiwan to administer the
estate of Mr. xxx. If required, please also state the reason why no grant
has been applied in Taiwan.
