假設應完工日期為 d day
廠商也確實於 d day 提完工報告
然後, 採購法也沒說 d+1 day要辦驗收
如果 d+4 才去辦驗收
d+2 監造單位用查驗的名義去看 ... 然後用查驗缺失(這些所謂的缺失,
實際上是未完工的部份 => 一小部份而已, 約1%) , 要廠商改善
,.....
感覺程序上, 游走邊緣

因為完不完工, 是要看實況, 而不是看他的書面報告, 是否?
也就是說應該要罰 d+1 ~d+3 逾期違約金, 比較對, 是不是?
結論: 我想知道, 虛線以上的處理做法, ok 不 ok ?
如果不ok, 是怎樣的不ok
(1) 違法, 圖利 => 刑事責任
(2) 對於所謂的俊工,查驗定義認識錯誤, 導致錯誤的行政決定 => 行政責任
(3) 實務上還 ok, 屬機關裁量權範圍
