一、就目前現實考績評比不公的情況下,如何確定固定3%丙等就能杜絕考績不公的情況
?還是只是擴大考績不公造成的不公平現象?
二、公務員分簡、薦、委,請問簡任官及薦任擔任主管的公務員甲等比例為何(請考試院
不要就「薦任」全混為一談,薦任官等中還有主管及非主管職位之分)?考試院秘書黃雅
榜在接受訪問時曾說過:簡任官要「自己放棄自己」才會被打到丙等,那麼對於基層公務
員並沒任何具體表現不佳之處,卻要因機關中強制固定3%丙等就可能面臨丙等,差別待遇
是否太大?
三、甲等比例再降為65%,而實務中高階文官及薦任擔任主管職公務員幾乎全為甲等,對
基層公務員是否公平?而實施3%丙等是否同樣對高階文官及主管同樣全無影響,卻多增加
優等可以分配?
四、考試院試辦強制丙等的情況可說是全面失敗,連應該站在保障公務員權益立場的
公務員保障暨培訓委員會本身在試辦時,也評比新調入的公務員丙等(該公務員於原機關表
現優良),為何又不論失敗與否,卻又強行推考績法修正草案?若如此,所謂試辦也只是
多此一舉,何庸試辦?而試辦都失敗了,面對更龐雜、更機能不一的公務機關時,又如何
會突然變成功了?
五、考績中乙等為良,亦即是公務員表現中等以上,而丙等代表劣,受評丙等對公務
員影響鉅大,不但代表被開除三分之一、停原職俸等,沒考績獎金外,連年終獎金也無,
尚須接受輔導等等處罰措施,受評二次丙等還必須降級改敘,那麼沒具體、明確應受懲處
事項,僅以機關強制一定比例丙等,是否違反無罪推定原則?是否會淪為機關內整肅異己
的手段?如新聞中六堵海關那位唯一一位不與之同流合污,卻因此遭廠商黑函檢舉的基層公務員面
對機關長官、同事沆瀣一氣貪污時,還可堅持自己原則,若當這樣固定比例3%丙等實施後
,面對的是工作權有無的壓力,其他基層公務員不見得有這位新聞中的小基層這般幸運,
叫其他基層如何自保?又將如何潔身自好?
六、公務員若受丙等申訴救濟管道形同虛設(如公務員保障暨培訓委員會亦打新人丙等)
,救濟過程曠日廢時,就算意外救濟成功,為錯誤考績評比之機關主管所受的懲罰僅為考
績乙等?
七、因為社會上工作環境不佳、民間企業對勞工的工作權保障不足(如無薪假或責任制等
),造成大量高學歷人才紛紛參與國家公職考試,高考、普考、甚至於初等特考都不乏碩
博士生應試,錄取者佔極大比例以上學歷極佳,基層公務員並非沒有人才,而實務上新人
、調動者或沒背景者幾乎都是乙等的首選,那麼甲等比例全被高階文官及主管占據,比例
又從原先的75%降為65%甲等,代表新人要連拿二年甲等幾乎不可能,而又要取消原考績法
中二乙一甲可升等的規定及乙等年功不得晉級,相當於國家招考文官進來後,即使學經歷
俱佳,但若身為基層公務員就代表幾乎無法陞遷,文官體系頓時成一灘死水,又如何稱之
為文官改革?而甲等原先幾乎都是高階文官或主管自行瓜分,新設的所謂「優等」又怎麼
可能落入基層文官階級?等於變相肥高官、瘦小吏!
八、基層公務員工作種類繁多,而且其中有相當多基層公務員非為授益性行政,若基
層公務員實務作出為人民之不利益處分、罰鍰或舉發時,常常面臨民眾投訴或黑函等,所
謂的工作態度如何評比?當與同機關內部主管或非對外窗口同事相較時,這些可能直接遭
受民眾不滿的基層公務員所謂工作態度及民眾滿意度是否就比其他人在評比時處境更為不
利呢?
九、請問各機關績效評比如何訂定?如消防隊是要以撲滅火勢的時間,還是以所撲滅
搶救的房屋間數為主?當若決定要以房間數為主時,遇到公寓大樓或透天厝時又如何計算
?而基層公務員面臨3%丙等壓力時,是否會為爭取所謂績效,反而變相扭曲手段(例如刻意
不救災,讓房子多燒幾間再救火)?另外,公務機關內部工作內容不一,就單以同機關論
評比,那麼是否擔任收發工作跟擔任工程發包等等承辦人員間就不同業務內容如何評比?
誰又應為丙等受罰?有些只是工作項目不同,而工作分配亦為主管決定的情況下,擔任所
謂較無法看出明確績效工作者,是否就應該為固定3%丙等受罰的對象?這樣績效評比的公
平性又何在?而業務量較大的基層公務員是否又處於多作多錯的危險中,較易出錯的工作
機關中誰願意做?又由誰來做才公平?
十、考試院強行推動強制固定比例3%丙等,揭明以淘汰公務員為主,先不論考績評比對
基層公務員不公、破壞公務員體制設計以永業制保護公務員依法行政及行政中立的原意,
另外,當真如考試院強制淘汰實施後基層公務員失業,而公保年資又無法與勞保年資併計
,勞工的退休年資是可以隨更換工作而不受影響的,那麼對所謂"應該(?)被淘汰"的公務
員的失業後保障又為何?相關配套全無全盤考量,整個法案僅以為所謂改革而改革,如此
急就章的法案只是淪為傷害基層公務員工作權為主,陷基層公務員連最低的工作保障亦無
的絕地,公務員失去公職身分後,仍為國民,甚至於連一般勞工都具有的保障,而為何獨
失業之公務員不受其庇護呢?相關後續法案的配套何在?
十一、公務機關中職位因該承辦人退休或調職等種種原因,職位都有遇缺未補的情況,其
間職位由他人或職務代理人代理,職務代理人是正式人員到任後就離職,業務內容及工作
要點、相關法令等大都由其他公務員輔導下學習,即使身為主管,因其本身並未直接承辦
業務,對工作及業務內容未能盡知。當強制固定3%比例丙等的情況下,所有同機關公務人
員皆處在零和賽局的壓力中,亦即同事及主管等皆處於工作權有無的競爭中,主管因為掌
握評比考績之大權自己保證甲等外(考績委員會實際上形同虛設),其他基層公務員為了避
免本身可能成為固定比例丙等受害者,對於新人或他機關調入之公務員,更有可能明知其
行為違法或失職、不妥而不加以指導,任其發生錯誤等情事,以造就有人考績墊底,保護
自己的平安一年的情況發生;或就同事業務往來,刻意就自己職掌部份隱瞞重要事項,造
成其他同事業務過失等等,以上處於惡性競爭環境下可能發生的惡意競爭,於公務體系中
所造成的影響更加深遠,亦可能直接或間接造成民眾權益受損、國家行政措施滯礙難行,
小小惡意涓滴成江海,機關內彼此勾心鬥角,請問又如何奢言機關內協力合作提升績效?
↑以上是我寫的簡單的爭議點,會連同其他網友的意見送立委陳情,請大家看看有無補充
的意見或覺得應該刪減的,我再修正內容後定稿,另外針對政黨部份,我會再寫篇說帖,
政黨說帖部份就不公開了,請大家若有對考績法及考試法等修正內容或意見、遭到考績不
公平評比的事例等等,請在這一二天內寄站內信給我,我整理好後除寄送到立委信箱中,
並會壓縮檔案後轉寄給要向其他立委陳情的網友,若有要索取資料幫忙向立委陳情的,亦
