台積電研發部戰將梁孟松離職轉戰南韓三星,台積電懷疑梁洩漏奈米技術給對手,憤而提
洩漏營業秘密訴訟。最高法院昨天判決梁禁止使用、洩漏台積電的營業秘密及人事資料,
而且判決他在「競業禁止期限結束後」,今年底前仍不准到三星工作,全案定讞。
我國法院過去從未限制企業高階主管,在競業禁止期限結束之後,還不能到競爭對手公司
工作,但本案最高法院採取保護國內大企業營業秘密的態度,即使未認定梁孟松洩漏台積
電的營業機密,仍然史無前例判決禁止梁孟松在過了競業禁止期間之後,今年底前不能到
台積電的對手三星公司工作。
法界人士指出,台灣近年屢爆高科技產業營業秘密外洩,最高法院這件指標性判決頗有宣
示意味,不只保護台灣產業,更保障台灣整體國際競爭力。
梁孟松在台積電服務十七年,他二○○九年二月辭去研發處處長,並與台積電簽下競業禁
止條款,二年內不得任職其他科技公司;但梁孟松在二○一一年競業禁止期限一滿,當年
七月就加入三星電子,擔任研發副總經理職務。
台積電質疑,梁孟松二○○九年赴韓國成均館大學教書時,已陸續洩漏機密技術給三星,
而梁教的學生有多位是三星的資深在職員工;另外,台積電委託專家製作「產業關鍵製成
結構分析比對報告」,發現三星的四五、三二、二八奈米世代,與台積電產品技術的差異
快速縮小。
台積電根據這份報告等一百七十二項證據,先後向新竹地院及智財法院提起假處分,禁止
梁在三星工作,但被駁回;台積電再到智財法院另對梁孟松提出營業秘密訴訟,請求梁不
得洩漏台積電的營業秘密和研發人員資訊給三星,且禁止他今年十二月卅一日前到三星工
作。
智財法院一審認為,禁止梁孟松在競業禁止期限結束後上班,是剝奪梁的工作權,僅判決
梁不准洩漏台積電的營業秘密和人事資料;但智財法院二審認為,若梁孟松在今年底前繼
續為三星服務,他勢必持續使用或洩漏台積電營業秘密,逆轉改判准許台積電全部的請求
。
梁孟松不服上訴,最高法院維持二審見解,認為梁在年底前任職三星,台積電的市場競爭
優勢將嚴重減損,我國晶圓代工業的競爭力也會喪失,合議庭判決梁孟松敗訴確定。
