(中央社記者葉素萍台北2日電)考試院今天公布影響33萬餘公務員的公務人員考績法
修正草案,除了新增優等上限為5%,甲等以上比例以65%為上限,丙等比例為3%,
若累積3次丙等就要辦理資遣或依規定退休。
考試院舉辦新春記者會,銓敘部提出考績法修正草案,待考試院院會審查通過,
將送立法院審議。銓敘部長張哲琛指出,現行考績機制,
每年甲等及乙等比例達99%以上,考績法已流於形式,無法達到當初考績管理目標。
張哲琛表示,新修正考績法以「工作績效」為核心,相較於現行
考績評比以50%工作表現、20%操行、15%學識、15%才能,
新修正考績法將採70%工作績效、30%工作態度來考核公務員績效,
並授權各機關視業務特性擬訂考核細目,報請主管機關核定。
張哲琛說,新修正草案考績等次限制,明訂優等以5%為上限,
甲等以上以65%為上限,丙等不低於3%。
相較於現行考績實施每年甲等比例以上不超過75%,
新修正草案優等加甲等比例合計70%,這屬於「漸進式改革」。
草案中規定,公務員第1次丙等留原俸級並輔導改善,
第2次考績丙等降1級改敘,第3次考績丙等則辦理資遣或強制退休。
考績丙等的條件包括,工作考績在機關內排序最後3%;挑撥離間、
不聽指揮破壞紀律;延宕公務造成人民權益損害;
洩漏公務機密或違反行政中立情節重大;
業務失當造成人員傷亡、財物損失,或負擔國家賠償責任等。
另外,張哲琛說,草案引進「同官等比較」概念,
同官等考列甲等以上人數比例,不超過75%,至於主管考列甲等以上人數,
則訂為85%為上限,他認為,這可以打破以往「高官、主管都是甲等」的迷思。
張哲琛指出,考績法修正草案也結合團體績效評比,
且更重視面談機制,除1年2次面談,並引進同儕之間的評比;
另外,考列丙等的公務員,可以透過保訓會復審機制救濟,
如果主管的考績不公允,會被追究責任。
考試院長關中表示,推動改革時,一定會有人感覺自己利益受損,他
也陸續聽到外界很多聲音,不過,相較於考績法對公務員整體權益提
升,這些枝枝節節,有時是以偏概全甚至是很極端的例子
,是不成比例的,「難道路上有石頭,就不要走路了嗎?」
關中說,文官制度被視為黑洞,對公務員而言,是莫大的諷刺
、誤會與傷害,考績法不改變,公務體系的訓練、陞遷、俸給都無法發揮功
能,考績法修正是文官制度能否跳脫泥淖、擺脫黑洞,重建
信心、贏得民眾信賴的起點。990302
