雖然「創見」評估黃不適合企業文化,法官認為勞動契約在創見發出錄取通知時就生效;
黃因無「勞動給付」,索償無據。
「創見」是國內記憶卡、隨身碟知名大廠。黃姓男子指控去年他應徵研發工程師,對方4
月12日發出錄取通知書,約定5月2日報到;「創見」要求他參加新進員工體格檢查,但因
他要到宜蘭玩,竟遭取消錄取。
黃說,「創見」承諾月薪5萬6千元,另有三節獎金,每年月薪平均約7萬,他要求創見給
付自錄取通知起至法院言詞辯論終結期間共42萬元薪資。黃另認為「創見」不錄用他涉及
汙衊,讓他經濟、精神受到壓力,要求公司補償他10萬元精神慰撫金。
「創見」則稱,黃去年2月26日提出面試申請,公司三度詢問他「什麼時候能報到?」,
但黃總說「我還要考慮」。
「創見」指出,他們決定錄取後,黃卻連體檢時間都不能配合,認為黃沒有進公司的誠意
。「創見」主張在考察應徵者的態度與行為後,認為他不適合公司才取消錄取。
士院勞工法庭認為「創見」明知公司非黃「首選」,仍發函錄取,勞動契約生效;黃雖無
法配合體檢日期,不代表不能在報到日前完成體檢。
訴訟期間,「創見」願讓黃復職;黃因未替「創見」提供過勞務,且幾天後即覓到新東家
,法官認為求償無理。至於黃自稱因名譽受傷而痛苦,士院認為「創見」人力資源部以電
子郵件與黃連繫,沒有他人知情,不構成名譽權侵害。
