有關初驗程序之必要性 - 土木

請教一下:
最近手頭碰到一件案子,其在驗收條款裡,勾選"工程竣工後,有初驗程序者..."之選項
而驗收人員便對該次驗收是否為初驗產生質疑
先節錄該條款如下:
5.本工程驗收程序,得為下列方式(由機關擇一於招標時載明)
(v)工程竣工後,有初驗程序者,機關應於收受監造單位/工程司送審之全部資料之日起
30日內辦理初驗,並做成初驗紀錄。初驗合格後,機關應於20日內辦理驗收為原則,
並做成驗收紀錄。.....
( )工程竣工後,無初驗程序者,機關應於接獲廠商通知備驗或可得驗收程序完成後
30日內辦理驗收,並做成驗收紀錄。.....
我查了上面兩個選項的條文剛好是政府採購法施行細則第93條和94條
但今天上面提到之前上級機關有函文驗收除非特殊性的案子,否則以一次驗收為原則
而本案因屬一般復健工程且未達查核金額,應可適用之前的函文
想請問的是,契約條款相較於行政命令或機關內部的函釋文,其優先性為何?
