最近遇到一件比較奇特的案件想聽聽各位
同業先進的看法,有一塊土地大致分為三
個所有權人持有,A持有一半,B跟C各持有
四分之一,已有建照,起造人為B,今有一公
司簡稱甲欲購買B的持分並同時向銀行申請
購地及建融貸款,且已向建管單位申請變更
起造人,但雙方協議的成交價明顯告於實價
登錄行情,銀行在估價上有困難,若持分
最大的A願提供其土地給銀行當擔保品但條
件是後續的建融銀行必須保證能承做成功,
在購地上來說,登於是雙方買1/4土地但
擔保品是1/4+1/2的土地,擔保品的估價遠
高於土地買賣的價格,乍看之下銀行債權似
乎能獲得保障,但對購地來說很明顯有高估
的事實,第一次遇到這樣特殊的案子,送總行
討論後認為能作跟不宜承作的意見都有,想
看看板上有沒有徵授信同業有遇過類似的案
件?
