特休問題 - 離職

請問版上各位前輩
假如 A君在103年12月2號到公司上班
但是 在104年中途有離職12天後又復職
這樣的話 到今年的12/14會有七天特休嗎?
那如果又是 A君打算105年2月離職
有問過人事 說這樣只能按比例原則下去算的話今年12月只有3個多小時
而明年到二月只有幾天特休
請問這樣有違反勞基法嗎?
