留職停薪後的特休怎給? - 人資

我是人資新鮮人,最近遇到一個問題
舉例來說某位員工在2010/10/1即辦育嬰留停
預計於2011/11/1復職,在留停前的年資3年依本司特休規定為15天
我想問的是:
他在11/1復職後是否就要發放他的特休假
15天*( 273/365)=11天
因為有聽說這位員工復職之後有考慮一陣子後要離職
那麼 如果11/1就給去年度的特休那不就又開始請特休,
然後如果有撐到明年度,接著他又有16天的特休,
本司很怕他把特休一次請完後,就離職了.......
因為查不到 給假的時間點,聽同業人資說
可以規定留停復職後半年或是三個月後再給特休
不知道這樣是否有違規定呢??
