退休員工爭取夜點費補助 中油敗訴得付差額

林姓與孫姓等7名退休台灣中油公司員工主張中油少算「夜點費」(加班費用)給他們,
要求中油須補付退休金差額。橋頭地院法官審理後,判員工勝訴,中油得依員工的加班情
形補付20至24萬元新台幣不等的差額。
林姓等員工認為,他們在任職期間都有參與全天候24小時輪班制度,分為日班、小夜班
與大夜班等,上大夜班者可得400元、小夜班可得250元,屬於工資的一部分。但7名員工
在與中油結清勞退舊制年資退休金時,卻發現中油沒有將這筆款項列入「應補發退休金」
,因此提告,要求中油補發。
中油則指出,夜點費是否屬於工資的一部分,得依個案認定,是否符合「因工作而獲得的
報酬」及「經常性的給予」二要件,就算有經常性地給予如勉勵或恩惠性質,難以認定為
工資。且此屬於公司為體恤員工而發放的津貼,曾於1980年訂定「台灣油礦探勘總處夜班
工作人員夜點費支給標準表」,後來才演變成夜點費。
中油還以經濟部國營事業委員會曾經發函解釋為例,夜點費屬於點心費,是福利性措施
,與夜勤津貼不同。這7名員工理應知道公司規定與其工資計算方式,在任職期間沒有對
此提出異議,但在退休後才提出核算出錯,有違誠信原則。
法官認為,中油採輪班制度,上大、小夜班的員工每月雖因值班天數多寡而導致夜點費
有所差異,多數月份的差額領取約數千元,顯見其加班屬於常態性。中油雖主張此不因員
工的工作內容、年資、職級不同而有差別,但夜點費屬於員工加班應得的款項,兩造對此
並無爭議。
法官審理後指出,夜點費是勞工因工作所獲得的報酬,在制度上也具有經常性,符合勞務
對價性及經常性給與的要件,依勞基法第2條第3款規定,屬於工資性質。法官判員工勝訴
,中油應給付給這7名員工20至24萬元的夜點費差額,可上訴。
