我是工地負責鄰損的案件 不過我是公共工程的 提供我一點小小處理的經驗
1.基本上我們也是現場工程師去現場基本的研判
如果開工前有做建物現況調查 那基本上就單純許多
如果沒有那就比較麻煩
除非很明顯是施工影響 不然記得法定上鑑定是由事主去找
鑑定確定後再決定由哪一方支付費用
2.因為不知道您在哪個縣市
之前有碰到民眾申訴1999或是市長信箱
那個基本上都是有處理期限 而且要處理到事主滿意
公務部門可能會因為要處理完 如果沒有太嚴重的話會要求營造廠商協助處理
3.千萬不能等到完工
因為損鄰案也是有追溯時限的 之前碰過因為太久沒申訴
很難認定原因 最後就不了了之了
