後來找法務討論
中央法規違建是不補償的,但地方政府自治條例為了降低行政阻礙,多設有拆遷補償條例
,包含本府也有,也經內政部相關函釋是沒有與法律衝突的
目前長官也預計會針對本案再召集相關局處開會討論
一些細節漸漸清楚後心裡踏實許多
其實我也只是擔心在這案子的一些細節法令在尚未完全釋疑的情況下辦理會有誤觸法網的
疑慮(因為我們並不是徵收單位,對於徵收、拆遷補償等相關法令與程序並不熟悉)
並沒有要鬥任何人的意思,只希望能夠保護自己,也保護每一位長官,畢竟大家都在同一
條船上

小的目前任職於某直轄市
近期處理到一個棘手的案子,懇請前輩指點
民國79年發布某都市計畫,80年公所辦理徵收
於徵收時在某一塊土地上有建物,但徵收清冊卻記載此地為空地
故僅發給土地徵收費用,而沒給建物徵收費
屋主也因此沒有搬走,甚至屢屢擴建
原本80年照航照圖顯示為一棟一層樓建物(樓層沒很有把握,80年航照圖並不清楚)
現況已是三棟三層樓建物加一座鐵皮屋
而公所也因該地上有建物而遲遲無法開闢
後於86年屋主向行政院提起訴願,內容主要是說:
公所徵收土地後遲未開闢,故要求返還被徵收土地
本訴願案遭行政院駁回,理由為:
公所已陸續針對該都市計畫進行開發,雖尚未開闢到系爭土地,但不代表未來不會開闢
本案陸續遭監察院、審計室糾正,認為都市計畫發布近20年,公所皆未開闢該土地
故公所發文屋主要求限期拆除,否則將逕為處理,但後來也無疾而終
公所後來方式為發起訴訟,要求對方拆屋還地,並返還五年的土地使用費
法官詢問為何按照航照圖上顯示,民國80年時該地有建物,卻沒有給建物徵收費用?
公所表示該建物依土地法第215條為依法不得建造,故不予徵收
於土地徵收條例第5條也載明,依法不得建造之建物,不予徵收
且從航照圖看,民國80年建物小小一個,現況卻已是豪華的三棟三層樓建物
明顯經過擴建,在對方已明知沒有土地所有權的情況下仍占用公家土地擴建,其心可議
甚至質疑現今建物跟80年時建物根本已不是同一個了,故沒有徵收的必要
並表示對方收了土地徵收費用後也沒有提出建物徵收等異議
時至今日也早已過了公法15年的請求期,意即已過追溯期
但後來這個案子因為升格直轄市而轉到我手上來承辦
同時由市長、議員下來的壓力,要求本案須朝和解方向辦理
並給付對方拆遷救濟金後搬遷
(本案委任律師非常不贊成這種方式,認為已經進到司法程序
就不該私下接觸對方談和解,而且這種和解內容割地賠款,基本上跟對方勝訴沒有兩樣
再說,本案他有9成以上勝算,如果要和解應該是我們有疏失,有可能輸
才會各退一步談和解,但這個案子幾乎不可能輸
不過後來科長親自打電話給律師,口氣非常不好,說律師只是我們委任的
隨時可以換一個,律師只是幫我們做事的,我們要怎麼做就照我們的意思
後來律師也就好吧那就看你們想幹嘛就幹嘛吧)
因此這個案子變成導向公所於80年徵收時有疏失,而現在補發徵收救濟金
但發文公所時,公所都堅持當年是依法辦理,開會通知單發了也都不來
本案對造為某里長,同時是里長聯誼會的會長,在地勢力龐大
動員了n名議員為此案關說(n>5)
甚至於某次於現場查估時,看到我們的人到了,就把我們叫進去喝茶
然後打電話給市長,過沒多久,市長就帶著數名議員到了現場
並且指示我們,對於這個案子,從寬認定
局長有次指示,邀請該里長來開個會,不用發開會通知單,電話聯絡就好
該次會議里長就帶著律師及兩名議員一起來開會
(雖然後來議員都只簽了名就走了,只留下助理在場)
甚至看到公所沒人來,就打電話給區長
大罵沒有開會通知單你們就不來是不是?事情就是被你們搞砸的現在還不來,走著瞧
過一會兒,公所主秘就乖乖到開會現場報到,但基本上完全不表示意見
只說這年代久遠,承辦人員都不在了,且業務已經移交,他尊重主辦單位的意見
會中里長非常強勢,要求高額拆遷救濟金,並且要頗長的搬遷期限,還要我們降低要跟他
收的使用補償金,且錢要先給他他才要搬,拆遷救濟金計算方式也應該用現在的建物估算
因為沒人能知道80年時的狀況,所以用現在的三棟三層樓建物加一座鐵皮屋及現在的房價
來算才對
局長也低姿態的說,這個案子我們大家是把烏紗帽擺一邊在處理的
連對方律師也說這案子市府這邊很幫忙了,里長才沒進一步講東講西
我找了府內的政風單位討論這個案子
政風聽完覺得這種處理方式毫無依據,根本都是用喬的
政風某科長提了上中下三策給我
上策:本案處理方式在上簽的時候,寫的技巧一點
讓未來這個案子被查了也不會有我的責任
中策:擺爛不辦這個案子,反正頂多黑一陣子,考績差了點,局長科長一定比我先頂不住
他們就會找別人辦,我會黑一點,但起碼不會被抓去關
下策:這個案子市長已經表態,基本上府內沒人救得了我,但可以求助府外單位
如果監察院、審計室、調查局等單位介入,那這些牛鬼蛇神就會全部躲起來
我會黑到爆炸,但最安全。
這個案子在上簽的時候,我會了一些單位,但被局一層長官要求刪減
認為會了這些單位會把事情複雜化,對方提的意見我們會難以回應
其中我認為應該要會辦公所,畢竟公所是這案子的起頭,也是前一手的主辦機關
目前處理的方向是要朝他們當年疏失來辦,也該會他們讓他們知道或是表態
但長官依然認為不需要會辦公所
局內政風主任針對這個案子找過我討論,認為這個案子確實有些奇怪的地方待釐清
因為我有會辦府內政風,因此局政風跟我說我要平行分會時把文和附件整理好拿給他
由他親自拿去府政風當面解釋,這樣府政風才會比較清楚這個案子
但是後來局政風向局長報告,說我有填會辦府政風,局長大發雷霆,在局長室大吼到整層
都聽到,當天晚上局政風就打給我,要我明天一早把府政風的會辦拿掉
現在各局處的會辦意見回來了
法務局認為本案既然是依法不得建造的建物,就沒有"漏未徵收"之情事,且放了81年最高
法院的判例,認為這個案子不應和解、賠錢,也不該降低使用補償金,而徵收的話應該已
民國80年徵收時點的建物狀況來徵收,不該用現在已擴建且與當時明顯不同的建物徵收
其他局處則口頭跟我說這案不宜這樣做,但是簽辦意見只填請依法卓處
局內長官則認為法務局的法律素養不夠(!?)
本案建物在都市計畫發布前即已存在,那他就是合法房屋,並沒有依法不得建造的問題
就算他真的是依法不得建造好了,在當年違建是不予徵收,但現在違建是可以徵收的
只是徵收費用要打個六折七折,那我們就打折後以違建的價格徵收
因為以前沒有違建可以徵收的法令,但現在有了,我們可以選擇對人民有利的方式處理
所以要我綜簽後陳府一層
我嘗試要用兩案併陳方式,以甲案繼續訴訟待司法判決後依法處理
或是乙案以建物現況先行撥發徵收救濟金、使用補償費減半徵收等方式和解
但被打回票,要求我要用"擬"先行撥發徵收救濟金、使用補償費減半徵收
讓市長批可或如擬的方式來寫簽
感覺故事有點長...
想請問各位前輩,這個案子是真的有問題,還是我太大驚小怪了?
我們單位不是負責徵收的單位,我本身是技術類科也不是學法律的
但總覺的原本是我們要贏的官司,要叫人家搬走再收個幾百萬的使用補償費
搞到現在變成我們要賠人家幾千萬的徵收救濟金,美其名是和解,但事實上是敗訴
雖然也不是我的錢,但納稅人的錢是這樣讓人家移到特定人口袋嗎...
而且照對方的勢力,也難怪公所20年來動不了他
有幾個問題想請教
1.這個案子局內長官的見解對嗎?真的可以這樣解釋然後補發徵收救濟金嗎?
2.如果這樣做是不可以的話,我有什麼辦法可以自保呢?
