※ 引述《Gorbachov (hollow brain)》之銘言:
: However, the number of subjects tested in NYBX is actually larger than
: that in CBX. And most of CA laws resemble the Federal laws (except Cal
: Evidence and Cal professional resposibilities). in NYBX you need to memorize
: a lot of NY exceptions. But it's the depth of the questions and longer
: test time set the two exams apart. It is said that NYBX is like a sprinter,
: and CBX marathon. Undeniably, the two are the most difficult bar exams
: among the 51 bar exams in the US. Only the CBX is slightly harder (average
: passing rate for foreign credentials is aound 10%, compared 60-70% for ABA
: accredited JD graduates).
As a CA-licensed attorney (active status), I just want to point out that
CBX also has its own "CA-specific" subject, namely, California Community
Property, and it is likely that at least one essay exam or one performance
test will involve issues relating to CA Community Property.
Also, California has an exclusionary bar, which means that rather than
merely trying to screen out people who are incompetent, the exam is
used to regulate the number of lawyers in the state. Other states have
shorter and easier bar exams, because they don't have the large number
of attorneys that California has.
Around 50 percent of CBX applicants passed according to prior records.
While this is technically true, it does not accurately reflect the
statistics. In 2003, the State Bar did a study that determined the
break-down of eventual pass rates, over three attempts: 90 percent
of graduates of ABA-approved law schools eventually pass, compared
to 68 percent who attend California accredited schools and 58 percent
for graduates of unaccredited schools.
The overall pass rates for California are lower than other states
largely because unlike most states, California allows graduates of
unaccredited law schools to take the bar exam (there are over sixty
law schools in California alone, only 20 of which are ABA-accredited).
: The value of a US bar is minimum in Taiwan. It's not the problem of the US
: bar, but the problem of Taiwanese legal market. Many has discussed about
: this so I would defer the answers to them.
: Sorry can't type Chinese. Hope this thread shed some lights to the myth of the
: NYBX and CBX.
