行政院長吳敦義對於考試院推出《考績法》修正案,強制規定三%的丙等比率表示質疑,
認為是齊頭式的平等。台北市副市長李永萍也反對,認為對具競爭力的小機關不公平。也
有人指出「如果一個機關的公務員都很認真,且表現優異;另一個機關則績效很差,打混
摸魚的人很多,這兩個機關都打三%,對於績優單位並不公平。」這種說法好像是認為全
國八千個機關,每個機關都要打三%。但仔細看看銓敘部送到考試院的草案,丙等的計算
單位是「主管機關」。《考績法》的主管機關,在中央為部會,在地方為直轄市或縣市政
府,因此並不是每個小機關都是三%,各機關丙等比率還要配合團體績效評比彈性調整。
以台北市政府為例,若團體績效評比結果,李永萍認為文化局表現最優異,工務局績效最
差,則文化局的丙等比率可以是零,工務局則可能是六%,但台北市政府丙等的總比率還
是要維持三%。中央部會也一樣,經濟部國貿局的丙等可以是零,智慧財產局則可能是五
%,但整個經濟部還是三%。
從績效管理的理論來說,人員的淘汰本來就要有策略性的差異,而不是齊頭式平等,才能
達到留強汰弱的目的。人數少的機關,確實可能所有公務員都很優秀,但當丙等的計算單
位是整個部會、整個縣市政府時,「所有的公務員都表現優異」這個前提可能存在嗎?少
