各位前輩好 在下有ㄧ件事想請教 感謝
在下承辦ㄧ件人民申請案件,屬於檢附合格資料
即可享有利益的案件,因為申請人提供的資料不夠
完善,於是我當天就電洽申請人請他補資料,然後
隔天我就被投訴了!
被投訴後首先得到主管輪翻上陣來問我怎麼ㄧ回事
我ㄧㄧ解釋後,單位副主管就去跟申請人溝通了,
溝通後
副主管請申請人補了ㄧ份還是不合規定的資料,
並且跟我說要我不要為難申請人,然後說,你如果
真的會擔心,你可以寫簽把情況照實寫,這樣層層
核章你也沒責任啊!
聽完他的話我很開心的回去寫簽了,查了又查,
很天真的把情形客觀寫好,最後寫請惠示卓見,
心理想著主管要是寫准予辦理,我就讓申請人申請
(這份案子是屬於偏裁量行政,法律只規定大方向
,但如果根據內部工作手冊來說是有爭議的)
簽ㄧ陳核後,才到股長就被退件了,股長叫我直接
發文請他補資料,於是我就發文了,稿陳核通過了
三個上級主管,到了單位副主管時,我的文被退
了。他請我的股長轉告我,發文請他補,如果他補
不出來,就必須拒絕他的申請,不能發文。
於是又去要求申請人補資料,但申請人總是態度非
常強硬的說,他沒有資料好補,我們公家機關應該
是要便民,要為民服務,他的資料已經夠齊全,
如果要補資料或退件,直接發正式公文給她再說!
於是我只好繼續上簽,但是我還是覺得她檢附的資
料不夠完備,所以簽還是寫惠示卓見,但股長說不
行,那是會平行機關的。我就還是客觀陳述事實後
在文末寫 當否,請裁!
然後單位副主管又回來找我了,他說我不能這樣寫
,我必須要自己認定核不核准,他只能寫如擬!
我就說:但如果讓我認定 我不會准啊! 他就說:那
你就不要准啊! 於是我就說:謝謝主管,那我發文
。於是他又生氣的說:你再去找股長溝通!
隔天,股長被副主管叫去談話後要我本來的簽要幫
我修改,我就說,如果要以承辦的角度寫他都合規
定那我蓋不下去啊!股長就離開了。
後來我把請申請人補件的文修改好,陳核上去,
又印了公務員保障法17條,說如果副主管還是不願
意發文,寫書面指示給我吧!
結果股長直接把它附在公文夾裡,於是我就被叫
進單位主管辦公室了。
主管說 他讓我寫簽會稿其他單位,給我一點信心,
我也接受,如果其他單位都同意准許,那有這些文
件,我也同意!
會了三個單位,目前兩個單位回復了,ㄧ個單位請
我們自己認定,另ㄧ個單位建議我們請對方補件,
這中間,申請人每ㄧ到兩天就會打來問辦的如何,
ㄧ下態度很好,ㄧ下非常兇狠的罵我事情不是這樣
處理的,霹靂趴啦罵ㄧ堆,頻頻催!
跟他告知在簽會其他單位所以還在彙整資料,今天
他早上又打來了,直接找股長。股長也跟他說還在
彙整,於是,她又打去上級投訴了。
投訴後,我們股長當然ㄧ直安撫他情緒,接著請
他補資料,對方當然不肯補,於是我們股長就說出
「那不然看你手邊有什麼補什麼好了!」然後他又
補了ㄧ份不合規定的資料。
我真的很無奈,為什麼投訴就非讓他申請不可,
而且沒有任何人願意擔這責,全部推我身上,
發文上簽ㄧ直被退,問我辦結期限是幾號,但是不
是我想延誤,我ㄧ直有在處理啊!
主管又常亂開支票讓他補ㄧ堆不合規定的文件就硬
要我同意她辦理!可是我不想啊!當初讓我會他單
位的意見不就是要依意見辦理嗎?
補不出來不就應該否准嗎?
副主管ㄧ再對我施壓要我不要刁難申請人。
真心希望大家能提供我意見,如果申請人不補件,
主管又ㄧ再退我文,辦理期限已經逾期好幾天了
,感覺就是ㄧ定要我簽他都合規定才肯讓我結,該
怎麼辦才好,這種情況有辦法申訴嗎?
