昨天(10/21)老板把同事一個一個叫進去,談資遣的事,他列出以下A、B兩種資遣方式
以公司某同事的例子,2008/3/10到職,年假7天剩1天,保障底薪14個月
採新制,年假及保障底薪部份,未滿一年按比例發
A、資遣費=25000*8/12*0.5=8333
年假未休=25000*(1/30)=833
資遣預告=25000*10/31=8065
本月薪資=25000*20/31=16129 合計應領:33360元
B、資遣費=25000*2*8/12=33333
本月薪資=25000*20/31=16129 合計應領:49462元
B部份的資遣費那塊,其實是保障底薪的部份,只是用資遣費的名目給我們
就我所知按勞基法規訂,應該是A的33360+B資遣費33333=66693元才是
請問大家這樣是合法合理的嗎?謝謝
