日月光工程師溢付廠商工程款被炒 資方「這原因」慘吞二連敗

林姓男子在高雄日月光半導體製造公司擔任廠務工程師,因為一次工程驗收不當、溢付工
程款給廠商,公司就認定他圖利廠商、強制解職,林男提告爭取資遣費。一審認為林男失
職情節並不嚴重,判日月光處置過當敗訴,需給付林男50萬元並開立非自願離職書。日月
光不服上訴,高雄高分院認為,日月光只需要透過監督、懲戒就能改善類似情況,不需要
解雇林男,駁回上訴,可上訴。
林男在日月光擔任廠務工程師20多年,負責高雄廠產線生產機台二次配工程之評估、發包
、管理及驗收等業務。2020年7月某日林男一進公司刷卡就被叫到「員工服務中心」,警
衛用金屬探測器對他搜身,還命令他把身上東西全部交出並軟禁在會議室內,不得對外通
訊。歷經2個多小時調查,公司以「業務疏失」為由逼林男簽離職單。林男不簽,仍當場
遭公司免職,當天就被解雇。
日月光表示,依照內部「工單作業流程」,工程施作前與施作中工程師均應抽檢材料,施
作中應統計進場施工人數,驗收階段應測試工程應有之效用,及確認工程實際耗用之材料
品項與數量及人工,是否與訂購單相符,確保公司應付款項與工程實際狀況一致。
但2020年5月公司接到匿名檢舉,二次配工程發包有用工用料不實致溢付工程款之情事,
公司立即組成專案小組,發現林男負責的「日月、坤琳」兩工程訂購單數量與現場盤點數
量有差距,溢付工程款各為27萬6175元、16萬5035元,公司懷疑林男長期抽檢、驗收不實
,已破壞公司與外部廠商信賴基礎與和諧關係,情節重大,依相關規定予以免職並解雇。
林男解釋,公司盤點材料的數量與廠商實際施作數量不符,許多工程用料並未計入盤點數
内,且工程剩餘材料均放在公司內,申報資料也有留存,自己不可能將材料攜出。此外,
自己負責的日月、坤琳2項工程均為統包、總價承攬工程,非實支實付工程,工程價格均
由公司採購單位決定,所有工程都有按照工程施作,也按照工程統包價給廠商。若廠商實
際施作數量與訂購單不符,高出3成則為工程追加或追減,小於3成就照原價付給廠商,絕
對不可能溢付工程款。
林男不服,提告爭取資遣費。一審法官調閱相關人、物證,發現林男工作上確實未落實材
料之驗收及人數統計,但應屬一時但忽職守,並非長期刻意為之,所生危害並非重大。法
官認定日月光處置過當,判敗訴,需付給林男50萬元資遣費、非自願離職證明書。
日月光不服上訴,二審法官認為,林男的疏失,並未影響日月光與相關廠商的業務合作關
係,林男過去也未曾發生類似怠忽職責的情事,並非屢犯不改,日月光只需要透過監督、
懲戒(記過)就能改善類似情況,不提供林男教育訓練或其他改進措施,等於剝奪林男事
後改善的機會,有違比例原則及最後手段性原則,最後仍判日月光敗訴,全案仍可上訴。
