TVBS電視台新聞部去年5月以「優退」方式瘦身裁員,月薪15萬的工程技術部于姓資深工
程師疑遭裁員旋風掃到,6月也遭資遣。于男憤而提告

于男提告指出,他每月薪資15萬1974元,TVBS是國內首家衛星電視台,擁有5個電視頻道
,近年所營事業頂目未見變更,去年6月卻以業務性質變更,有減少勞工必要為由資遣他
,他數度寄發存證信函,並向台北市政府申請勞資爭議調解,都遭TVBS拒絕。
TVBS開庭時稱,公司自100年起重心轉移至網路新媒體,大幅使用網路傳輸技術,且自102
內部系統升級後,已非于男所熟悉的技術,自103年以後,公司為因應新計畫,經過多次
改組,該組原先工作由組長及2名組員就能負擔,確有減少勞動力需求,于男卻態度消極
,無法配合精進技術,且公司無其他職務內容符合于男專長、年資及薪資,不得已才採取
最後手段,終止他的勞動契約。
法官調查發現,TVBS加入網路技術後,工程技術部原來的業務仍存在,工作內容更多,對
於勞動力需求應不減反增,且TVBS103年為因應新計畫改組,直至104年5月才開使安裝新
技術機器,預計今年7月上線,與于男遭資遣時間相差近1年,卻指他消極未能配合學習,
明顯草率不稽。
法官認為,以于男原有專業,只要經過適當訓練,應能勝任新技術業務,TVBS卻在安排教
育訓練前就將他資遣,明顯不合法,因此判僱用關係存在,TVBS須自解僱日起至復職日止
,按每月15萬1974元計算給付于男。
