特休計算方式 - 離職

各位先進好,
因為剛入行沒多久,最近公司在規劃特休的提案,
所以想請各位協助檢視制度是不是有不恰當之處。
因公司都是在當年度1.1即產出特休,故目前規劃如下:
A君於2014.7.1到職
2014.7.1-2014.12.31 給予3.5天特休 (若於2014.12.31前離職需追回)
2015.1.1-2015.12.31 給予7天特休(若於2015.12.31前離職依在職比例給予)
2016.1.1-2016.12.31 給予7天特休(若於2016.12.31前離職依在職比例給予)
2017.1.1-2017.12.31 給予10天特休(若於2017.12.31前離職依在職比例給予)
2018.1.1-2018.12.31 給予10天特休(若於2018.12.31前離職依在職比例給予)
2019.1.1-2019.12.31 給予14天特休(若於2019.12.31前離職依在職比例給予)
2020.1.1-2020.12.31 給予14天特休(若於2020.12.31前離職依在職比例給予)
依此類推,想請問
1.這樣算是優於勞基法嗎?
2.若於年度前離職則依在職比例給予,這樣會有違法之虞嗎?
