工程會的契約定型稿, 都有敘明,
非可歸責余廠商而導致契約終止, 都有補償條款(補償廠商所受損失)
那如果, 我把補償條款全部刪除,
改成機關得因政策因素, 隨時終止契約, 廠商不得異議要求補償
------------------------------------------------------------
這是不平等條約,
但因為公開招標階段, 就已經把不平等條約的條款都公告,
廠商都知道,
他還來簽約, 基於契約自由的原則,...
廠商如果去申訴(我只能想到, 以衡平原則去主張那些條款無效), 是不是必敗?
如果廠商必敗
那有沒有酸民想過, 把所有補償條款全部刪除的做法,
讓以後履約管理更方便?
