久任獎金返還問題 - 離職

公司久任獎金制度:
每年一次性給付,
未滿一年離職須全數歸還.
並附上台財稅第36469號條文說明,
此屬違約性質不能從所得扣除,
如果有長期病假或是產假等等狀況久任日期會延期.
近期剛離職
公司規定返還久任獎金只能付現,
且不給任何收據,只有公司的代收小姐自己有手寫紀錄,
????
這樣好像完全沒有任何依據我有歸還獎金耶,
這樣對勞工有保障嗎?
