公務員三丙急轉彎!走人機率近於零 馬英九改革宣告破功 - 考試

考試院銓敘部完成考績法修法,丙等比率則訂為3%,每三年檢討一次,拿過三次丙等
的公務員就得被資遣或依規定退休,引發公務員反彈,行政院也質疑齊頭式平等有爭
議,馬英九總統也對此保留。
原先堅持立場的銓敘部長張哲琛24日改口說,將改採「功過相抵」,「一次優等」或
「連續三年甲等」就可以抵一個丙,10年內若累積3個丙,而沒有後功抵銷先前丙等記
錄,就要被資遣或退休。
銓敘部2日公佈考績法修法草案,新增優等上限5%,甲等及優等總量管制則為65%,較
過去甲等75%降低十個百分點,而丙等比率則訂為3%,每三年檢討一次,拿過三次丙等
的公務員就得被資遣或依規定退休。
考試院預定25日舉行院會審查通過後,再送立法院審議。
張哲琛24日上午受訪時指出,功過相抵的概念,考試院長關中也同意,畢竟,考績法
修訂意旨是要鼓勵公務員,不過,功過相抵必須要有時程,銓敘部希望訂在10年內。
銓敘部指出,功過相抵概念是希望鼓勵公務員,與先前立法意旨一致,考績法改革不
是為淘汰而淘汰,這樣的修正沒有什麼轉彎或從寬的問題;至於訂定10年期限是依大
法官583號解釋,行政懲處追究期眼最長為10年。
至於外界有疑義的丙等下限3%標準部分,銓敘部說,這部分尊重考試院及立法院審查
決議。
銓敘部24日的說法,形同政策大轉彎,公務員擔憂的吃三丙走人機率將幾近於零,馬
總統所強調的改革,也因為擔心公務員鐵票流失而宣告破功。
