台積電前研發部資深處長梁孟松被韓國三星挖角,台積電向智財法院提告,法官審理
 
認為台積電的資料屬於營業秘密,梁孟松有保密義務;昨天判梁禁止使用或洩漏台積電營
 
業秘密,也不能對第三人刺探情資;但競業禁止時效已滿,駁回禁止梁到三星工作的訴求

梁孟松的委任律師顧立雄昨天說,已告知梁判決結果,營業秘密部分本來就有遵守,
 
但台積電要求的範圍不明確,至於競業禁止被駁回,他認為是勝利;並表示收到判決書再
 
決定是否上訴。
 
 
台積電企業訊息處處長孫又文表示,看得出法院力挺台積電捍衛商業機密的決心,已
 
交由公司法務部門與董事長張忠謀共同討論判決結果,基於訴訟成本包括時間及金錢花費
 
的考量,公司目前尚未決定是否提出上訴。
 
 
據查,梁孟松1992年7月進台積電服務,2009年2月自研發處長職位離職後,到清華大
 
學電子工程研究所任教一學期。梁因太太是韓國人,同年9月經妻舅介紹到韓國成均館大學
 
任教,前年五月被挖角擔任三星研發部副總經理。
 
 
台積電認為,梁在台積電任職長達17年,參與許多半導體專利技術研發,主張梁不能
 
使用或洩漏該公司營業秘密,且到後年12月30日止,禁止梁以任職或其他方式為三星提供
 
服務,也不得提供研發部門人員相關資料給三星;梁說競業禁止條款屆滿後才到三星工作
 
,未違反規定。
