勞委會指出,配合經建會推動自由經濟示範區規劃,勞委會繼先前有意放寬定型契約年限
到3年後;將再度大幅鬆綁現行勞基法對變形(彈性)工時的限制。未來變形工時有可能
從目前的2個月上限,放寬到半年,以配合雇主旺季時的加班需求。
勞委會也主張,未來示範區內適用延長變形工時的企業,正常工時也必須從目前的兩週84
小時下修到每週40小時,也就是馬英九總統政見所宣示的週休二日,但這部分經建會還沒
有同意,仍須繼續溝通。
勞委會說,為配合經建會自由經濟示範區草案下會期將送立院審查,這一波勞動條件鬆綁
擬先以特別法(示範區草案)排除勞基法適用,未來則會修改勞基法,逐步擴大到區外企
業一體適用。
勞委會主委潘世偉說明,變形工時拉長到26周後,雇主可因旺季或急單需求,在特別時間
內打破法定正常工時規定,讓勞工可增加工時,但就算變形工時拉長區間,為免勞工在旺
季時做到「爆肝」,勞委會仍堅持每上班7日,勞工須休息1日。而且並非所有產業都可以
任意採用變形工時,須經勞委會同意的產業且經勞資雙方達成協議才可實施。
全國產業總工會批評,勞基法規定,超時加班部分,1天以4小時為限、1個月不能超過46
小時,一旦變形工時拉長到半年,勞工可能面臨淡季休假1個月,旺季集中上班,屆時一
毛錢加班費也拿不到,勞工做到死,薪水卻更少,健康、薪資兩頭空。此外,雇主在旺季
多請人手的情況也將成歷史,對提升就業無幫助。
