部分企業在勞工到職時,會簽約要求未來若離職,一定期間內不得跳槽到同行工作,即「
競業禁止條款」,國內航空和科技業契約較常訂類似條款,但因法無明訂,遇爭議時法院
見解不一。
勞動部近日研擬行政指導原則,建議企業必須是基於保護營業秘密及優勢技術,才能要求
員工簽署競業禁止條款,且禁止就業期間最長2年。離職禁業期間僱主需給予至少半薪做
為補償,且不得用先前給的紅利或獎金折抵。若未約定補償條款的競業限制,屆時到法院
恐怕會視為無效。
至於勞工若違反競業禁止條款的罰則,勞動部說參考原則並無明訂上限,但有揭示若約定
違約金過高,法官可依《民法》第252條規定,減至較合理的數額。不過,該原則僅供勞
資雙方參考,並無罰則,約定條款是否無效也須由法院判定。該參考原則近日將公布,未
來《勞動契約法》修法方向也會朝此原則進行。
