Force Majeure. “Force Majeure” means any event beyond the reasonable control
of the affected Party which results in or causes the failure or delay of the
affected Party to perform its obligations under this Agreement. This includes,
without limitation, fire, storm, flood, earthquake, accumulation of snow or i
ce, strike, lockout or other industrial disturbance, war, terrorist act, block
ade, revolution, riot insurrection, civil commotion, sabotage, act of vandalis
m, governmental restraint or act of legislature, provided that lack of funds a
re not interpreted as a cause beyond the reasonable control of a Party.
