考績打丙的配套規定與相關子法
1.考核以工作績效為核心,各機關得自訂關鍵績效指標。
2.落實平時考核,詳細作法在考績法施行細則中明定。
3.增設面談機制一年至少二次及對績效不佳人員預警(告)機制。
4.增訂考績丙等條件。
5.機關、單位之團體績效與個人考績相結合,各主管機關有彈性調整比率之空間。
6.考績等次人數比率,得每三年由考試院會商其他院通盤檢討是否調整。
7.小機關考績等次人數比率,授權在考績法施行細則中訂定調整機制。
8.落實同官等為比較範圍,簡薦委各官等均可能有考列丙等者,不會集中於某一官等
或只是低階人員。
9.程序正義:考績委員會之組成,票選委員占二分之一以上,並研議得加聘學者專家
等公正人士參加。
10.考列丙等者,將於考績法施行細則中另定輔導改善機制。
11.十年內累計三次丙等才予以強制資遣或退休(並非免職)。
12.後功可抵前過(一年優等或連續三年甲等可抵銷一次丙等紀錄)。
13.防止輪流考列丙等的機制:
(1)課責對象:1.單位主管。2.辦理考績人員。3.機關首長。
(2)保障方式:1.考績委員會給予陳述及申辯機會。2.復審救濟。3.保訓會言詞辯論。
14.防止機關首長拒打丙或濫打丙的機制:核定機關有實質審核權,銓?部對機關考績
有銓?審定權,不合規定者均可退回重加考績。
15.防止反淘汰機制:對初任、娩假、政治報復的防範等,將分別在考績法及其相關子
法中訂定防範措施。
16.修正及訂定五項子法彌補考績法規範不足:
(1)考績法施行細則。(2)考績委員會組織規程。
(3)團體績效評比辦法。(4)面談辦法。(5)激勵辦法。
