高雄銀行一家分行廖姓經理前年遭3名女員工申訴性騷擾,3女指控廖男利用單獨面談機會
緊握她們的手2至3分鐘,並在下班時間打電話、評論她們身材等,高雄銀行調查後認定性
騷擾成立,2020年11月決議將廖男解任,廖男不服,提告聲稱因高雄市長換人捲入派系鬥
爭而遭解聘,求償至原訂任期每月13萬餘元薪資共273萬餘元,但台北地院採信高雄銀行
主張,認定雙方委任關係可隨時解除,今判廖男敗訴。
判決指出,廖男聲稱他被認定性騷擾是被「羅織構陷」,在3女申訴性騷擾的前2天,他就
被公司要求自行離職,他認為這是因為他在高雄市前市長韓國瑜任內獲聘,2020年現任高
雄市長陳其邁當選後,高雄銀行內部就「改朝換代、派系鬥爭」,他是高雄銀行前任董事
長朱潤逢面談錄用,不是新任董事長屬意人選,因此受到牽連。
廖男主張,他原本簽約受委任在2020年6月至2022年6月擔任分行經理人,每月薪酬13萬餘
元,他任內完成分行的建置,並達成聘任當時約定業績標準,並非不能完成工作,也沒有
不正當行為,而他擔任分行經理的契約屬於委任與僱傭混合契約,高雄銀行片面解任已違
反《勞基法》,造成他損失2020年11月起至2022年6月任期為止損失預期薪資,要求賠償
共273萬餘元。
高雄銀行辯稱,廖男簽署的是委任契約,不是僱傭契約,不適用《勞基法》,委任關係依
據《民法》規定,只要雙方信賴基礎動搖,委任可以隨時終止,且廖男的委任契約中明訂
,廖男若有不正當行為,高雄銀行可以終止契約,而廖男性騷擾行為經調查認定屬實,違
規情節重大,影響雙方信賴基礎,解除委任完全合法,請求判決免賠。
法官審酌,廖男在性騷擾調查中已承認有對3女握手、下班打LINE、對1女評論身材等行為
,廖男雖辯稱握手是女同仁主動、打LINE只是確定她們狀況、談論身材只是鼓勵女同仁身
材好,但性騷擾的成立應以被害人感受為主,廖男行為確屬《性別工作平等法》規定的性
騷擾行為。
法官認為,高雄銀行性騷擾申訴評議委員會認定廖男性騷擾成立,董事會認為委任關係無
法繼續,因而解除委任,按照《民法》,委任契約只要雙方中任何一方認為信賴基礎動搖
,不論有無正當理由,都可以隨時通知另一方終止委任契約,因此高雄銀行解除廖男委任
契約,並無任何違反法令之處,廖兆毅請求賠償薪資損失無理由,判決廖男訴求駁回。可
